White said, "Two weeks ago we wrote two letters to McDonnell giving him details of this executive order and asking what his plans were to counteract it.
"EO 13528 specifically discusses matters involving the National Guards of the various states and 'synchronization and integration of state and federal military activities in the United States.' Thus it clearly violates the Posse Comitatus Act, as well as the Constitution.
"McDonnell has said he favors the Tenth Amendment, reserving to the states powers not delegated to the United States by the Constitution, nor prohibited by it to the states. This EO is obviously a Tenth Amendment matter, but McDonnell won't lift a finger to back up his words with action, and defend citizens of the Commonwealth against federal tyranny.
"In March of 2009 Governor Nixon supported and defended the now infamous MIAC Report listing Ron Paul supporters, libertarians, people who display bumper stickers, people who own gold, or even people who fly a U.S. flag, and equating them with radical race hate groups and terrorists.
"In response to Nixon, three former presidential candidates — Chuck Baldwin, Ron Paul, and Bob Barr — sent a letter to Missouri officials protesting the MIAC Report. Appearing on The Alex Jones Show on March 19, Baldwin said that he and his fellow letter signatories were considering legal action if the letter did not result in a repudiation of the MIAC report and its inflammatory allegations."
White added that "On March 26, in response to media coverage of the report and public outrage over the document, Missouri Highway Patrol Superintendent James Keathley engaged in damage control and pulled the MIAC report. 'The head of the Missouri State Highway Patrol has shut down a controversial report linking right-wing groups with the modern militia movement,' the Associated Press reported. In response to the public fallout, Lt. Gov. Peter Kinder called on the director of the Public Safety Department to be placed on administrative leave pending an investigation.
"Nixon then did an about face, declaring he 'was not governor when the MIAC was formed, did not hire any of the people there and nobody in his administration --- the director of public safety --- saw the stuff before it went out.'
"But now Nixon will soon be discussing national security and terrorist threats with the Secretary of Defense, the Secretary of Homeland Security, the Assistant to the President for Homeland Security and Counterterrorism, the Assistant Secretary of Defense for Homeland Defense and Americas’ Security Affairs, and most ominously the commander of NORTHCOM.
"Nixon’s initial support for the MIAC Report reveals that he agrees with its conclusion that libertarians and supporters of Ron Paul are domestic terrorists. It is significant that he will be sitting on a council along with members of the Department of Homeland Security.
"Last April, a DHS document entitled 'Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment' surfaced. The DHS document characterized returning veterans, gun owners, and opponents of Obama and big government as domestic terrorists. It also listed those opposed to abortion or immigration as potential extremists and cited groups that reject federal authority in favor of state or local authority as potential sources of hate crime.
"In August, after a whirlwind of negative coverage, research by Americans for Legal Immigration revealed that the MIAC report had no reliable supporting evidence and was in essence crafted by the radical leftwing Southern Poverty Law Center and the Anti Defamation League."
White also said, "Two weeks ago we forwarded to Gov. Haley Barbour, R-Miss., chairman of the Republican Governors Association (RGA) copies of the two letters we sent to McDonnell Jan. 21 and Jan. 22, and asking what action RGA would be taking on this matter. But Barbour never did a thing either.
"It's clear that despite the formal calendar for the 2010 General Assembly session, an emergency joint resolution should immediately be introduced declaring firmly that Executive Order 13528 is unconstitutional and a violation of the Posse Comitatus Act, and that the Commonwealth will not participate, cooperate or be guided in any way by any actions of the Council of Governors, all of which will be unlawful and dangerous to the freedom and safety of citizens of Virginia.
"We also strongly believe that McDonnell should be formally censured by the General Assembly for his conspicuous failure to take obvious action to protect all the citizens of the Commonwealth."
